5-5-1: CURFEW REGULATIONS:
   A.   Age And Hour Restrictions; Exemptions: It shall be unlawful for any minor under the age of eighteen (18) years to be in any public grounds within the City between the hours of eleven thirty o'clock (11:30) P.M. and five o'clock (5:00) A.M. the following day unless such minor is accompanied by a parent or guardian, or other adult person having the care and custody of said minor, or said minor has written permission from such parent, guardian, or other person having the care and custody of the minor to be in such a public place or be on the streets, alleys, or public grounds within the City. However, the provisions of this subsection do not apply to a minor who is lawfully married, or to a member of the armed forces of the United States on active duty, or to a minor in the act of going to or returning home from lawful employment. Each violation of the provision of this subsection shall constitute a separate offense.
   B.   Violations; Penalties:
      1.   Minors: Any minor violating the provisions of subsection A of this section may be detained and treated in accordance with the provisions of the Juvenile Corrections Act, title 20, chapter 5 of the Idaho Code.
      2.   Parents, Guardians, Other Adults:
         a.   Any parent or parents, guardian or other person having the care and custody of any minor or minors, as defined herein, who permits or abets said minor or minors to violate subsection A of this section shall be deemed guilty of contributing to the delinquency of said minor or minors.          b.   Any adult violating the provisions of subsection B2a of this section shall, upon conviction, be guilty of a misdemeanor and be punishable as provided in section 1-4-1 of this Code. (Ord. 229, 6-22-1989; amd. 2018 Code)
