925.33 INDUSTRIAL PRETREATMENT INFORMATION REQUIRED; CONFIDENTIALITY.
   (a)    The Safety-Service Director shall require a user of the sewage system to provide specific information needed to determine whether or not the user is in compliance with this chapter. The information may include:
      (1)    Flow rates into the sewage system, including peak rates and volumes for a specified period of time. The volume of flow used for computing industrial waste surcharges shall be metered water consumption of the user as shown in the records of the water meter readings except as provided in this section. If the user discharging industrial wastes into the sewage system procures any part or all of this water from sources other than the City's water system, the meters shall be of a type approved by the Safety-Service Director for the purpose of determining the volume of water obtained from those other sources. The user discharging industrial wastes into the sewage system may install and maintain at his expense metering devices for determining the volume of waste being discharged to the sewage system, from which the industrial waste surcharge would be computed. The measuring devices shall be a type acceptable to the Safety-Service Director. The Safety-Service Director may require the installation of devices for measuring the volume of waste discharged if these volumes cannot otherwise be installed, owned and maintained by the user. Following approval and installation, such meters may not be removed without the consent of the Safety-Service Director.
      (2)    Chemical analyses of the discharge constituents and characteristics, including those pollutants as part of all pretreatment standards applicable to a user.
      (3)    Information on raw material, processes and products affecting wastewater discharge quality.
      (4)    Quality of a specific liquid, sludge, oil, solvent or other materials important to the sewage system control.
      (5)   A plot plan of sewers of the user's property showing sewers and pretreatment facility location.
      (6)    Details of wastewater pretreatment facilities.
      (7)   Details of systems to prevent and control losses of materials through spills to the sewage system.
      (8)    Such information as may be required by the City's NPDES permit.
      (9)    Standard Industrial Classification Number.
   (b)    Information and data concerning a sewage system user which is obtained pursuant to this chapter can be declared confidential by the user if the user is able to demonstrate to the satisfaction of the City that the release of such information, process or methods of production is entitled to protection as trade secrets or is proprietary information of the user. Information classified as confidential shall not be transmitted to the general public unless written permission has been obtained by an authorized representative of the user. Information shall be transmitted to government agencies in accordance with 40 CFR, Section 403.14 and Ohio R.C. 6111.05.
