(a) Except as otherwise hereinafter provided, sewer charges at the rates with respect to any premises shall be based upon the quantity of water consumed upon such premises during the applicable sewer charge billing period as measured by the City water meter there in use, or other meter installed as approved by the Safety-Service Director. The applicable billing period shall be monthly for all users.
(b) Premises located outside the corporate limits of the City which are served by the wastewater system shall be charged a fee equal to the rate charged for those within the corporate limits plus all costs associated with the debt service for the cost of the construction of the facilities necessary to provide said service plus all additional operations, maintenance and replacement costs for said constructed facilities.
(c) On premises using water supplied from sources other than waterworks system of the City and not measured by a City water or other meter acceptable to the Safety-Service Director, the quantity of water consumed shall be measured by a meter installed and maintained for such purpose at the expense of the owner or other interested party and acceptable to the Safety-Service Director, or the owner or other interested party may, at his option, request the Safety-Service Director to determine the amount of water consumed on the premises in accordance with accepted engineering practices; and the quantity of water consumed on the premises shall be the amount so measured by such meter or so determined by the Safety-Service Director.
(d) In the event that any premises discharge industrial wastes, either directly or indirectly, into the sanitary sewer system and the Safety-Service Director finds that it is impractical to measure such wastes by meter, such wastes shall be measured in such manner and by such methods as the Safety-Service Director finds practicable in order to determine the sewer service charge based upon the rate provided in subsection (b) hereof.
(e) In the event that the Safety-Service Director is satisfied that a portion of the water from any source consumed upon any premises does not and cannot enter the sanitary sewer system, then in such case the owner or other interested party may, at his expense, install and maintain such separate metering devices, or provide such data in conformity with accepted engineering practices, as shall demonstrate to the satisfaction of the Safety-Service Director, that portion of the water so consumed which is discharged into the sanitary sewer system, and such portion shall be the basis for measuring the sewer charge under subsections (a) and (b) hereof and in Section 925.27(e)(4) and (j) if applicable.
The sewer charges levied at the rates established by this chapter shall be billed on or about the first day of each calendar month, or each calendar quarter, as the case may be, and shall be payable within twenty days after billing. In case of failure to pay any bill for sewer charges when due and payable, a penalty of ten percent (10%) of such charge shall be added to such bill.
(f) Sewer Surcharge. A sewer surcharge shall be fixed by the City and levied for any person, firm or corporation whose premises are serviced by a sanitary sewer connection and discharges wastes other than normal sewage into the sewerage system.
1. Surcharge Formulas. Surcharges shall be based on the applicable constituents of the wastewater as follows:
A. Total suspended solids; and/or
B. BOD5, five days at 20 degrees Centigrade; and/or
C. Ammonia Nitrogen (NH3-N)
D. Phosphorus; and/or
E. Other parameters as deemed necessary by the Safety-Service Director.
Whenever the wastes are ruled acceptable to wastewater treatment and the wastewater contains suspended solids, BOD and/or NH3-N and/or phosphorus and/or other parameters as deemed necessary by the Safety-Service Director in excess of normal sewage, the excess shall be subjected derived in accordance with the following formulas:
SC = ((SS-200) x F x 834 x CS) + ((BOD5-210) x F x 834 x CB)
SC = Surcharge based on average daily flow.
SS = Total suspended solids in wastes as discharged in mg/l.
200 = Suspended solids concentrations in normal sewage in mg/l.
F = Flow in millions of gallons per day of wastes as discharged.
CS = Cost to treat one pound of suspended solids in cents per pound. Total operating cost attributable to total pounds of suspended solids/total pounds of suspended solids/total pounds of suspended solids removed.
BOD5 = BOD5 in wastes as discharged in mg/l
210 = BOD5 concentration in normal sewage in mg/l
CB = Cost to treat one pound of BOD5 in cents per pound. Total operating cost attributable to BOD5/total pounds of BODs removed.
SC = ((NH3-N - 21) x F x 8.34 x C4)
NH3-N = Total NH3-N in wastes as discharged in mg/l.
21 = NH3-N concentration in normal sewage in mg/l.
CN = Cost to treat one pound of NH3-N in cents per pound. Total operating cost attributable to NH3-N/total pounds of NH3-N removed.

2. Annual Review of Strength Surcharge. On or before March 1 of each year the parameters, base concentrations and cost to treat for the surcharges will be reviewed. The cost to treat the aforementioned parameters shall be based on the total operating cost of the sewerage works. Increases or decreases in the cost of treating and disposing of excess amounts of the aforementioned parameters shall be reflected on a proportionate basis in the strength surcharge on the basis of cost per pound.
3. Free Services: The City will implement a monthly billing for all City offices/departments which currently are not billed for sewer/wastewater service.
4. Notification: The City will implement an annual notification of the OM&R cost to all service customers to rates.
“The City will on an annual basis on or before March 1 of each year issue to each service customer a summary of the billing rates detailing debt service and operation, maintenance and replacement costs per 100 cubic feet per month of water usage."
