907.02 ASSESSMENT POLICY.
   Council further adopts the following policy with regard to assessments on future road repair, improvement and maintenance projects:
   (a)   All maintenance projects consisting of a simple asphalt overlay are to be the City's sole expense on all streets.
   (b)   Reconstruction regarding curb replacement and any necessary oversizing of drainage improvements are to be at the sole expense on all state routes and on any streets designated by ODOT to be on the Urban System shall also be solely at the City's expense as such improvement, repair and maintenance is to facilitate traffic flow by ODOT standards. The Urban System is as designated on the map of the City street and highway systems as attached to original Resolution R-5-83 and incorporated herein as Exhibit "B".
   (c)   Reconstruction, including curb replacement and drainage improvements on streets other than the Urban System or on the Urban System if petitioned by property owners, shall be done by assessment to be determined by Council using the following guidelines:
      (1)   The City shall at all times pay the total expense for improvements at intersections.
      (2)   If no curbing presently exists and if petitioned by the property owners, such property owners shall be assessed for the curbing project.
      (3)   If the owners or those presently holding title have previously paid assessments for curbing and the present owners petition to have new curbing installed, the property owners shall pay fifty percent (50%) of the total cost by assessment with the City paying the balance.
      (4)   The petitioning residents shall pay one hundred percent (100%) by assessment if storm drainage is added to the project.
      (5)   The petitioning property owners shall pay one hundred percent (100%) by assessment for any pavement replacement or widening costs.
   (d)   Council states as a matter of policy that it is Council's desire to have reconstruction work on other than the Urban System or on the Urban System in the absence of state funding be initiated by property owners petition in accordance with Ohio R.C. Chapter 727.
