(A) Any person contesting a parking citation issued under this chapter may request an administrative hearing within ten days of the citation being issued. The request must be in writing and delivered or mailed to the Office of the Chief of Police. The Chief of Police or his/her designee may dismiss the citation, return any fines or penalties paid after an informal review of the matter or forward the citation to the Traffic Committee for a formal hearing.
(B) An appeal under this section shall constitute a stay of penalties until a final decision has been rendered.
(C) The administrative hearing shall be held according to the following requirements:
(1) The administrative hearing body shall be the aldermanic Traffic Committee.
(2) Formal or technical rules of evidence shall not apply.
(3) The Traffic Committee shall be empowered to administer oaths and to secure by subpoena both the attendance and testimony of witnesses and the production of relevant reports, documents or other papers.
(4) Persons appearing at a hearing may be represented by counsel at their expense.
(5) At the conclusion of the administrative hearing, the Traffic Committee shall issue a written decision either sustaining or overruling the parking citation.
(6) All final decisions of the administrative hearing officer shall be subject to review under the provisions of the Administrative Review Law.
