§ 33.023 POWER OF SEARCH.
   Whenever any person is arrested and confined to the city jail, it shall be the duty of the officer in charge to search and take from the person so committed all valuables, money, watches and all articles of personal property, and make a full and correct list or inventory of the same in a book to be kept for that purpose. The list or inventory shall be witnessed by the officer making the arrest or by some other credible person. Such property shall be retained by the officer until such person is discharged or committed to prison by the magistrate or court, when it shall be his or her duty to turn the property over to the person if he or she is discharged; and, if not, then to the officer taking such person to the county jail or other prison, to be delivered with the prisoner to the proper authorities. He or she shall take a receipt from the person to whom he or she delivers the property.
