§ 33.016 APPOINTMENT OF POLICE CHIEF, ASSISTANT CHIEF OF POLICE AND MEMBERS.
   (A)   All members of the Police Department, with the exception of the Police Chief and Assistant Chief of Police, are hereby declared subject to the provisions of the 65 ILCS 5/10-2.1.1 et seq. The Board of Fire and Police Commissioners shall appoint all members of the Police Department in accordance with the above statute.
   (B)   (1)   All original appointments to the Police Department under and in accordance with the rules and regulations of the Board of Fire and Police Commissioners shall be for a probationary period of one year.
      (2)   At the expiration of such probationary period, such appointment to the Police Department shall automatically become permanent; provided, however, that, the Board of Fire and Police Commissioners may, at any time during the probationary period, discharge such appointee after notice and assignment of cause for removal therefrom.
   (C)   (1)   The Mayor is authorized to appoint, suspend or discharge the Police Chief and Assistant Chief of Police with the consent of the City Council.
      (2)   In the event the Mayor discharges the Police Chief and Assistant Chief of Police, he or she shall revert to his or her permanent rank, if any, as the Police Department has established under the Fire and Police Commission Act, being 65 ILCS 5/10-2.1.
