(a) Curfew Hours; Exceptions. No minor under the age of eighteen years, unaccompanied by a parent, guardian or custodian, shall be upon the streets or other public places in the City, between the hours of 11:00 p.m. on Sunday through Thursday nights and 6:00 a.m. of the succeeding day, and between the hours of 12:00 midnight on Friday and Saturday nights and 6:00 a.m. of the succeeding day. However, where a minor has attended a school or athletic function, an educational or civic project, or an event of a public nature, an additional one hour shall be permitted beyond the hours of 11:00 p.m. or 12:00 midnight as herein specified.
(b) Responsibility of Parent, Guardian or Custodian. No person, whether as parent, guardian or custodian of a minor under the age of eighteen years, shall knowingly permit such minor, unaccompanied by a parent, guardian or custodian, to be upon the streets or other public places in the City in violation of subsection (a) hereof.

(c) Action by Police Officer For Violation. Any police officer finding a minor in violation of subsection (a) hereof shall use reasonable diligence to summon such minor's parent, guardian or custodian to report to the Municipal Building where such parent, guardian or custodian will be courteously informed of the provisions of this section and such minor shall be released to such parent, guardian or other custodian.
(1) If such minor's parent, guardian or custodian cannot be located or if such minor has committed a second offense or if some other provision of Rule 6 of the Rules of Juvenile Procedure is apparent, such officer shall consider the filing of a complaint against such minor and/or the parent, guardian or custodian under the provisions of Rule 10 of the Rules of Juvenile Procedure and the detention of such minor under the provisions of Rule 7 of the Rules of Juvenile Procedure.
(2) In the event that detention of such minor is deemed necessary in accordance with such Rules, appropriate juvenile authorities shall be immediately notified and all other appropriate steps taken in accordance with such Rules.
(3) No such minor shall be placed in any jail, lockup or any other place where he can come in contact or communication with any adult convicted of a crime, under arrest or charged with an offense.

(d) Violation Classified. Whoever violates this section is guilty of a minor misdemeanor except that a minor under the age of eighteen years shall be proceeded against as may be appropriate under Ohio R.C. Chapter 2151.
