951.13 RESPONSIBILITY OF OWNERS AND TENANTS.
   (a)    All Residential or Commercial Customers shall only place solid waste and recyclables in regulation containers. All solid waste must be placed in trash bags with no loose, unsecured garbage.
   (b)    All Residential or Commercial Customers shall subscribe for garbage and rubbish pickup collection service with the City of Bellefontaine. In Double-Family, Triplex-Family and Multi-Family units or residences where the Landlord is charged by the Department of Public Utilities for the water and sewer service; that Landlord shall also be responsible for subscribing to and for the payment of the garbage and rubbish collection service options appropriate for those tenants residing in those units.
      
   (c)    All Residential Customers and Small Quantity Generators shall be billed for refuse collection in conjunction with their regular utility billings.
   (d)    Every residential address that is occupied will be held accountable for the safe keeping of their container(s) and recycling bin(s). All recycling bin(s) are to remain with the service address and are not considered property of the subscribing customer. Recycling bins that have been removed from the property is considered theft and subject to reimbursement and/or penalties as provided for under Section 951.99.
   (e)    All trash/refuse containers need to be placed at the curb for collection prior to 6:00 a.m. of their collection day and shall have the lid fully seated on the container. Any additional refuse will need to be contained in the regulation “Pay As You Throw” refuse bags. Recycling collection will be the same pick-up day, set out for collection by 6:00 a.m. All recyclables need to be sorted paper/fiber from metal/glass containers in different bins or separated in the bin, top and bottom with no plastic bags and shall be set out next to the trash containers. If it is found that the refuse or recycling was missed in collection due to the fact it was not set out by 6:00 a.m. contracted start time; the refuse/recycling will not be picked up until the following week collection day and there will be no credit of service amount. If it is for health and safety reasons that the refuse would still need to be picked up for collection, there will be an additional fee charged for this service as stated in the current Collector’s Contract Agreement.
   (f)    All trash must be containerized in regulation size, stickered containers assigned to the address where the garbage and rubbish was generated. All non-compliance will be considered theft of service for the purpose of compensation and prosecution.
   (g)    If a container needs to be replaced due to normal wear, damage, is missing or an exchange to a different size or option, the customer will need to contact the Department of Public Utilities in order to notify the City of any container option change and to receive the appropriate sticker authorization.
   (h)    Customer questions and quality complaints on refuse collection need to be directed to the City of Bellefontaine Department of Public Utilities to be resolved.
   (i)    No person shall allow garbage, trash, rubbish or other refuse to accumulate out-of-doors for more than one week at a time. Such matter shall be placed out-of-doors only in regulation lidded containers or plastic bags designed for such purpose. No person shall permit any fermented, putrifying or odorous garbage and/or rubbish to exist upon any property owned, leased, rented or controlled by him.
   (j)    Property owners or tenants who allow refuse to accumulate for longer than seven days shall be notified by certified mail to remove such accumulation. If such condition is not corrected within seven days of the mailing of such notice, the offender shall be cited into Municipal Court for a violation of this section.
   (k)    Commercial dumpsters will not be allowed at single-family residences unless there is an approved Commercial business in operation at that service address.
