925.04 BUILDING SEWERS AND CONNECTIONS; LICENSES AND FEES.
   (a)   License to Tap and Excavate Required. No unauthorized person shall uncover, make any connection with or opening into, use, alter or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the Service-Safety Director. An application for a permit shall be signed by the owner, agent or lessee of the property for which the connection is to be made and by the person, firm or corporation employed to perform the work, and must describe the property and state the fixture to be connected. No building sewer shall be constructed or repaired nor shall any connection be made to a public sewer by any person who has not been authorized and licensed to perform such work. All persons desiring to engage in the business of sewer excavating and sewer tapping shall, before performing such work, procure a license to do so from the Director. Before such license is issued, the person desiring to engage in the business shall file an application in writing with the Director, giving the name of the person, firm or corporation and of each member thereof and the place of business, asking to become a licensed sewer excavator and sewer tapper in the City, or in any area under the jurisdiction of the City and stating his willingness and consent to be governed in all respects by the laws and regulations of the City. The license application shall be signed by the applicant in person. Before receiving a license, the applicant shall execute and deposit in the office of the Director a bond with two or more sureties, to be approved by the Director, in the sum of two thousand dollars ($2,000) conditioned that the applicant will indemnify and save harmless the City from all accidents and damage caused by any negligence in protecting his work or by any unfaithful or inadequate work done by virtue of his license. The applicant shall also file insurance certificates showing public liability insurance coverage in an amount of not less than fifty thousand dollars - one hundred thousand dollars ($50,000 - $100,000) and direct and contingent property damage insurance in an amount of not less than ten thousand dollars ($10,000) for the life of the license. Such license shall be in force for a term of one year from the date of issuance. Before issuing such license, the Director shall demand and receive ten dollars ($10.00) from the applicant.
      (1)   When a sanitary sewer connection is made to a building property where there is no water connection, a separate accessible sewer shutoff valve will be installed. In addition, a meter will need to be installed on the waterline coming into the property from the well for consumption and billing purposes. The meter shall be installed within thirty (30) days of the completed sewer connections. (Ord. 19-87. Passed 12-10-19.)
 
   (b)   Permit, Inspection and Records Fees and Special Tap Fees. The Director of Service and Safety shall accept or reject all applications for connections to public sewers and shall keep records of all permits issued. A permit, inspection and records fee or seventy-five dollars ($75.00) for each connection shall be paid prior to the issuance of such permit. In addition to the permit fee, a special tap fee shall be charged for connections in certain locations as established below:
      (1)   Area I. All connections to any public sewer discharging sewage that will eventually flow through manhole number 1038 as shown on the Sanitary Sewer Map and Index on file in the City Engineer's office, shall pay a tap fee according to the following schedule:

      (2)   Area II.       (3)   Area III. All connections to any public sewer discharging sewage through the South Detroit Street Force Sanitary Sewer, as shown on the plans, maps and index on file in the City Engineer's office, shall pay the following tap fee:

      (4)   Area IV. All connections to any public sewer discharging sewage through the North Main Street Force Sanitary Sewer, as shown on plan GG-75 and map GG-8-A on file in the City Engineer's office shall pay the following special fees in addition to the regular tap fee as determined by Council. The special fees to be based on the amount of water usage shall be determined by the City Engineer or the City Service-Safety Director or his duly authorized representative, using the following methods:
         A.   By direct metering, if available, or;
         B.   By the most recent available guidelines for the proposed use as determined by the Ohio Environmental Protection Agency. The special fees for all uses will be two thousand twenty-nine dollars ($2,029) per gallon usage per minute.
      (5)   Area V. All connections to any public sewer discharging sewage that will eventually flow through manhole number 1064 as shown on the Sanitary Sewer Map and Index on file in the City Engineer's Office, shall pay a tap fee according to the following schedule:

      (9)   Area IX. All connections to any public sewer discharging sewage that will eventually flow through manhole number 995 as shown on the Sanitary Sewer Map and Index on file in the City Engineer's Office, excluding those sewer dischargers located north of U.S. Route 33, within the boundaries of the Crossroads Business Center as described in Exhibit "A" of Ordinance 90-60, or those whose sewage discharge eminates from manhole number 994, shall pay a tap fee according to the following schedule:

      (10)   Area X.       (11)   Area XI. All connections to any public sewer discharging sewage that will eventually flow through manhole number 1168 as shown on the Sanitary Sewer Map and Index on file in the City Engineer's Office, excluding any discharges originating from Northview Allotment consisting of 35.719 acres, shall pay a tap fee according to the following schedule:

      (12)   Area XII. All connections to any public, or private, sewer discharging sewage that will eventually flow through either of the two lift stations located on the south side of W. Sandusky Ave. (St. Rt. 47) in front of HBD Industries shall pay a Special Area Tap Fee according to the following schedule:
 
All Uses: $33.00 for each gallon per minute (gpm) of sewage discharge. The minimum fee is $500.00.
The Tap Fee shall be based upon the estimated discharge. After one year of operation the actual discharge rate will be calculated and the tap fee shall be adjusted accordingly.
      (13)   Area XIII. All connections to any public, or private sewer discharging sewage that will eventually flow through manhole number 1085 as shown on the Sanitary Sewer Map and Index on file in the City Engineer's Office shall pay a Special Area Tap Fee according to the following schedule:
 
All Uses: $500.00/Acre (Minimum Fee)
      (14)   Area XIV. All connections to any public, or private, sewer discharging sewage that will eventually flow through manhole number 1049 as shown on the Sanitary Sewer Map and Index on file in the City Engineer's Office, excluding any discharge originating from the approximately 66.738 acres currently owned by Harold Marker located on either side of Sloan Blvd. and bordered by Twp. Rd. 55, U.S. Rt. 33 and Ohio Hi-Point JVS, shall pay a Special Area Tap Fee according to the following schedule:
 
         A.   Properties contiguous to improvements:
            Residential   $400/Dwelling
            All Uses   $2,500/Acre Minimum Fee
            These properties are exempt from any other Area charges.
         B.   Properties not contiguous to improvements:
            All Uses   $-0-/Acre (Minimum Fee)
            These properties are covered by Area I.

      (15)   Area XV. All connections to any public, or private, sewer discharging sewage that will eventually flow through Manhole No. 731 as shown on the Sanitary Sewer Map and Index on file in the office of the Bellefontaine City Engineer shall pay a Special Area Tap Fee according to the following schedule:
 
All Uses: $1,500.00 per tap.
      (16)   Area XVI. All connections to any public, or private sewer discharging sewage that will eventually flow through Lift Station No. 8 as shown on the Sanitary Sewer Map and Index on file in the office of the Bellefontaine City Engineer shall pay a Special Area Tap Fee according to the following schedule:
 
Residential:
$400.00 per dwelling
All Other Uses:
$500.00 per Acre (Minimum Fee)
      (17)   Area XVII. All connections to any public, or private sewer discharging sewage that will eventually flow through Manhole No. 828 as shown on the Sanitary Sewer Map and Index on file in the City Engineer’s office shall pay a Special Area Tap Fee according to the following schedule:
 
All Uses:   $400.00 per tap.

      (18)   Area XVIII. All connections to any public, or private sewer discharging sewage that will eventually flow through Manhole No. 1484 as shown on the Sanitary Sewer Map and Index on file in the City Engineer’s Office shall pay a Special Area Tap Fee according to the following schedule:
 
Residential:   $400.00 per dwelling

   (c)   Additional Buildings on Lot. Where additional buildings as provided in subsection (e) hereof on the same lot or lots, or lots of subdivisions are connected to an existing sewer serving such lot or lots, or lots of a subdivision, a tapping fee, in an amount equal to the prescribed fee, is required for each additional building served by the new connection.
 
   (d)   Owner's Responsibility. All costs and expenses incident to the installation and connection of the building sewer shall be borne by the owner. The owner shall indemnify and save harmless the City from any loss or damage that may directly or indirectly be occasioned by the installation of the building sewer.
 
   (e)   Separate Sewer for Each Building. A separate and independent building sewer shall be provided for every building, except that where one building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear building through an adjoining alley, court, yard or driveway, the building sewer from the front building may be extended to the rear building and the whole considered as one building sewer, provided a proper easement for the use and maintenance of such sewer is stated on the application.
 
   (f)   Old Sewers. Old building sewers may be used in connection with new buildings only when they are found on examination and test by the Director to meet all requirements of this chapter.
 
   (g)   Pipe Specifications. The building sewer shall be cast iron soil pipe, ASTM specification A74-42 or equal; vitrified clay sewer pipe, ASTM specification C-200-66T premium joint pipe or equal; or other suitable material approved by the Director. Joints shall be tight and waterproof. Any part of the building sewer that is located within six feet of a water service pipe shall be constructed of cast iron soil pipe with leased joints or vitrified sewer pipe with approved rubber joints. Cast iron pipe with leased joints may be required by the Director where the building sewer is exposed to damage by tree roots. If installed in filled or unstable ground, the building sewer shall be cast iron solid pipe, except that nonmetallic material may be accepted if laid on a suitable concrete bed or cradle as approved by the Director.
 
   (h)   Size and Slope of Pipe. The size and slope of the building sewer shall be subject to the approval of the Director, but in no event shall the diameter be less than four inches. The slope of such four-inch pipe shall be not less than one-eighth of an inch per foot.
 
   (i)   Elevation. Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. No building sewer shall be laid parallel to or within three feet of any bearing wall which might thereby be weakened. The depth shall be sufficient to afford protection from frost. The building sewer shall be laid at uniform grade and in straight alignment insofar as possible. Changes in direction shall be made only with properly curved pipe and fittings.
 
   (j)   Lifting Sewage by Artificial Means. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sanitary sewage carried by such drain shall be lifted by approved artificial means and discharged into the building sewer.
 
   (k)   Excavations. All excavations required for the installation of a building sewer shall be open trench work unless otherwise approved by the Director. Pipe laying and backfill shall be performed in accordance with ASTM specification C12-54 except that no backfill shall be placed until the work has been inspected.
 
   (l)   Joints and Connections. All joints and connections shall be made gastight and watertight. The maximum leakage allowances for sanitary sewage laterals shall be 200 gallons per inch in diameter per mile of pipe per twenty-four hours. All test shall be witnessed by the Service-Safety Director or his duly authorized representative.
 
   (m)   "Y" Branch Connection. The connection of the building sewer into the public sewer shall be made by a "Y" branch, if such branch is available at a suitable location. If no properly located "Y" branch is available, the owner shall at his expense install a tapping "Y" with a flange in the public sewer at the location specified by the Director. Special fittings may be used for the connection only when approved by the Director.
 
   (n)   Inspection Prior to Connection. The applicant for the building sewer permit shall notify the Director at least twenty-four hours in advance of the time when the building sewer is ready for inspection and connection to the public sewer. The connection shall be made under the supervision of the Director or his representative.
 
   (o)   Barricades and Warning Lights. All excavations for building sewer installations shall be adequately guarded with barricades and lights so as to protect the public from hazards. Streets, sidewalks, parkways and other public property disturbed in the course of the work shall be restored in an manner satisfactory to the City Engineer and the Director.
 
   (p)   Owner's Responsibility. It shall be the duty of the owner of any premises having a building sewer connected with the public sewer to maintain his building sewer the entire distance from the building drain to the point of connection with the public sewer main.
