921.04 UTILITY SERVICE, BILLING AND DEPOSIT PROCEDURES.
   (a)    User Classes: The division of users within the Municipality's service area is to be determined by the function of such users. Stated in five general classes, they are:
      (1)   Residential user. Any user of the public water system, or contributor to the public sanitation and sewer system who is a single-family residential unit. The sole purpose of the property is for housing of a single-family residence. Such residence must be metered and billed as a single unit by the City Utility Department. Duplex, triplex and apartment units may be classified as a residential user only if each residential unit is metered and billed separately. Residential users shall also include any property not otherwise mentioned herein.
      (2)   Commercial user. Any user of the public water system or contributor to the public sanitation and sewer system whose primary function is retail, wholesale, service or other commercial activity. The purpose of said property is for the conduct of business.
      (3)   Industrial user. Any user of the public water system, or contributor to the public sanitation and sewer system whose primary function is the manufacture, fabrication, or assembly of goods classified as manufacturing by the City Zoning Code.
      (4)   Institution or other public user. Any user of the public water system, or contributor to the public sanitation and sewer system, whose primary function is public service. Such users may include, but are not limited to: hospitals, prisons, government offices, charitable institutions, and public service operations. Combined users shall be classified as Commercial Users for the purpose of computing user charges.
      (5)   Non-resident. Any user of the public water system, or contributor to the public sanitation and sewer system where the utility service provided is located outside the corporate limits of the City. Such user has been previously authorized by City Council.
 
   (b)   All charges for City utility services for all user classes shall be billed and paid monthly. The billing, payment and utility turn-off schedule for City utility services shall be as follows:

Initial Billing Amount
Dated the first of month, due on the 15th of the month
(2)
Late Amount Due
Sixteenth day of the month
(3)
Delinquent Fee Charged
Once the account is 45 days or more delinquent
(4)
Utilities turned off by City
Beginning with the second day of the month on accounts 45 days or more past due.
   (c)   All subscribers to City utility services shall, before City utility services are rendered, be required to make a deposit with the City Utility Department to be held as security for payment in full of such subscriber's bill with the City Utility Department; except that persons who own and reside in the residence for which application for utility service is being made, need not make such utility deposit. All residential subscribers will be required to make a one hundred fifty dollar ($150.00) deposit. All commercial and institution or public users will be required to make a two hundred dollar ($200.00) deposit. All industrial subscribers will be required to make a two hundred fifty dollar ($250.00) deposit. In the discretion of the Service-Safety Director or his duly authorized representative, a deposit of more than the stated user class may be required of certain proposed high volume subscribers and the Service-Safety Director or his duly authorized representative in the Utility Department shall set such required deposit based on the proposed use and volume of City utilities required.
      (1)   Further, any individual or potential subscriber who secures a City resident who is an owner of real property in the City and who has no delinquent City utility accounts as a co-signer for such utility services need not make such utility deposit. A subscriber is not eligible to be a co-signer for him or herself when the subscriber is renting a property as their primary residence.
      (2)   All deposits with the City Utility Department will be applied to the subscriber's final bill as payment thereon with any remainder to be returned to the subscriber. (Ord. 16-56. Passed 11-7-16.)
