905.11 PROCEDURE FOR STREET AND ALLEY EXCAVATION CUTS.
   (a)   The City does hereby adopt the procedure as set forth in subsection (b) hereof for obtaining approval for street and alley excavation cuts by utilities, contractors and individuals, which procedure shall be strictly followed for all street and alley excavation cuts.
 
   (b)   (1)   Obtain permit from City Engineer's Office.
      (2)   Permit requisition shall include detailed description of location, site, and number of cuts. Utilities performing a series of excavations shall submit a detailed program plan and obtain a permit for each street or alley separately.
      (3)   Permit fees shall be a minimum of twenty-five dollars ($25.00) for each cut and shall be accompanied by a minimum of one hundred dollars ($100.00) bond. The City Engineer shall establish higher bonds for more extensive work. Utility companies may submit an annual bond of five thousand dollars ($5,000) if they choose and they shall be solely responsible for restoring their own street openings within a thirty day period.
      (4)   All cuts made in pavement within City right-of-way shall first be outlined by saw cuts. Following repair work or pipe taps, openings shall be filled with ODOT item 304 machine compacted in 12" lifts. Other options of filling may be to use controlled density fill or tampcrete. These materials shall be liquid enough to fill all voids in the excavation. Prior approval must be obtained from the City Engineer as to method of repair. The City Engineer may give approval for alternative methods if, in his sole discretion, he approves the method.
      (5)   After backfilling with compacted granular or optional material, permit holder shall perform one of the options below, depending upon weather and seasonal conditions:
         A.   The contractor is to match the existing roadway's thickness of asphaltic concrete with the minimum following guidelines: Thoroughfares, State, County roadways place 6" asphalt pavement #404 compacted with minimum 5 Ton roller or vibrator compactor. Seal all edges at sawcuts with AC-20. Local streets and alleys place 3" asphalt pavement #404 or tar and chip covering to match existing pavement.
 
OR
 
         B.   Place temporary 3" cold mix patch if weather prohibits pavement patch. Maintain until permanent patch is replaced. Granular backfill or other option material to be placed as noted above.
         C.   Emergency repairs to be backfilled with granular material compacted as above and maintained. Place temporary or permanent patch within 72 hours of backfilling unless weather prevents asphaltic material from being placed.
         D.   On concrete streets use 6" concrete 6 bag mix flush with existing pavement. Tool edges and place sealant in perimeter joint.
      (6)   Notify City Engineering Office when work is to be performed so that procedures can be verified by Inspector. The City may complete or redo the work and charge the permit holder for work performed by City employees if proper procedures are not followed.
 
   (c)   Whoever violates any provision of this section is guilty of a minor misdemeanor upon the first offense; and a fourth degree misdemeanor upon each subsequent offense and/or violation thereof.
