It shall be unlawful for any person to create, keep or maintain a public nuisance in the city. Any person convicted of violating this chapter is guilty of a misdemeanor punishable by a fine of not less than one hundred dollars ($100.00) and not exceeding five hundred dollars ($500.00), or by imprisonment not to exceed six (6) months, or by both fine and imprisonment, for each offense. It is the intent of the city council that the criminal offenses listed in this chapter be offenses involving legislative intent. Those offenses shall not require proof of any one of the mental states described in Montana Code Annotated, subsections 45-2-101(33), (37) and (58). (Ord. 2002-6, 11-4-2002)
