(A) (1) Upon arrest, or upon appearance without arrest in response to a citation or summons, or at any time before trial before or after arraignment, the defendant may be eligible to be released upon giving bail for his or her appearance in an amount and upon conditions fixed by this chapter or the Judge, who shall prescribe appropriate rules of court for the receipt of bail and release of the defendant.
(2) In the case of arrests made at night or under other conditions of emergency, or when the Judge is not available, the rules shall authorize the Police Chief, or his or her designated representative, to accept a temporary cash bond of not less than $10 nor more than the maximum monetary penalty provided by ordinance for the offense charged.
(3) The Judge or Police Chief is authorized, subject to conditions as may be prescribed by the Judge, to release a resident of the municipality on personal recognizance.
(B) The city’s bail bond schedule setting forth specific offenses and bail bond amounts and procedures therefor, as amended from time to time, is hereby adopted and incorporated herein by reference.
