§ 99.99 PENALTY.

   A person who violates any provision of § 99.20 shall be guilty of an infraction punishable by:

   (A)   A penalty of $250 for the first violation;

   (B)   A penalty of $500 for the second violation within one year;

   (C)   A penalty of $1000 for each additional violation within one year;

   (D)   Penalties shall be processed through the City Court;

   (E)   If, after multiple violations by the same person, the City Attorney and the Beech Grove Police Department have reason to believe that the imposition of penalties will not be effective in enforcing § 99.20 , the city shall be empowered to seek any other remedies provided by law; and

   (F)   Penalties under this section shall not apply when the prohibited conduct is the subject of a new criminal offense under an applicable state or federal statute or when the prohibited conduct is the basis for the revocation or any condition of parole or probation.
