§ 34.28 GENERAL DUTIES.
   In the conduct of its duties, the Commission shall not create policy or develop standards relating to the standard operating procedures or guidelines of the Department. Rather, the Commission shall establish eligibility lists for probationary firefighter and other ranks resulting from selection and promotion processes that have been administered by the Department in accordance with rules and procedures established by the Commission and statutory requirements. The Commission shall also be responsible for making offers of employment to probationary firefighters from the eligibility lists. The Commission is responsible for recommending firefighters to the Chief for promotion from the eligibility lists. The Commission shall also be responsible for the ultimate determination of serious disciplinary matters when such discipline is recommended by the Chief, and for reviewing and ruling upon cases of lesser discipline (up to five days’ suspension) upon request in accordance with procedures established by the Commission. The Commission shall limit its involvement in the day to day operations of the Department to the matters specifically set forth in this subchapter and in IC 36-8-3.5, and the Chief shall remain responsible for the day to day operations of the Department.
