§ 91.097 FRANCHISE NON-EXCLUSIVE.
   The company acknowledges that its rights under the agreement constitute a non-exclusive franchise, as required by Indiana law. However, no application for additional non-exclusive franchises to construct or operate a community antenna television system in the city will be accepted by the city, except following a determination by Council by resolution or ordinance that an additional license or franchise should be granted for all or a portion of the city, and the establishment of procedures to insure that all interested parties, including the company, will be given an opportunity to submit proposals for such additional license or franchise. No license or franchise granted by the city to a third party during the term of this agreement shall be on terms favorable to such third party than the terms of this agreement.
