§ 71.38 WEIGHT LIMIT FOR STREETS DESIGNATED "NO TRUCKS".
   (A)   Weight limitations shall be utilized when required to prevent damage to local streets not designed structurally to repeatedly carry the load of heavy commercial trucks and large vehicles with a gross vehicle weight of 11,000 pounds or more.
   (B)   A uniform weight limitation of 11,000 pounds or more gross vehicle weight is hereby established for local streets not designed structurally to carry loads of heavy vehicles or not geometrically designed to allow such vehicles to navigate such street safely.
   (C)   Vehicles with a gross weight of 11,000 pounds or more or which are geometrically designed to be too large or bulky to safely navigate said local streets are hereby prohibited from driving upon local streets when such streets are posted with a sign indicating “No Trucks.”
   (D)   The prohibition of this section shall not apply to emergency vehicles to collect trash and refuse from the homes of residents on such streets or to vehicles making local deliveries or pick ups of furniture and appliances or similar items, nor shall the prohibition apply to vehicles necessary to repair and maintain said streets.
   (E)   The Board of Public Works and Safety shall post signs indicating “No Trucks” on local streets which are not designed for the load of vehicles with a gross weight of 11,000 pounds or more or which vehicles are too large to navigate said streets safely after making a factual determination concerning said street or streets.
   (F)   The Board of Public Works and Safety shall prepare and maintain a written schedule of all local streets designated “No Trucks” which schedule shall be published in the Beech Grove Code of Ordinances.
   (G)   Any person who violates this section shall be fined in an amount not to exceed $100 for the first violation and not to exceed $500 for any one or more subsequent violations.
