11-1-7: EXCEPTIONS AND VARIATIONS:
In specific cases where the subdivider can show that a provision of these regulations, if strictly adhered to, would cause unnecessary hardship because of topographical or other conditions peculiar to the site, and that a departure may be made without destroying the intent of such provision, the Plan Commission may recommend a variation or modification of the required standard or regulation. Such recommendation shall be communicated to the Board of Trustees or governing county authorities in writing with the reasons therefore. The Board of Trustees may approve variations from the requirements of this Title when, in its opinion, such variations will not adversely affect the intent of this Title.
