8-1-8: PERMISSION TO REMOVE:
It shall be unlawful for any person to cut, fell, injure, or remove any trees standing on any street, avenue, sidewalk, public right of way, or public grounds in the village unless such person shall apply to the village for a permit and obtain approval by the village's streets and alleys committee. The village shall issue such a permit only when such person has deposited the sum of three hundred dollars ($300.00) into noninterest bearing escrow account with the village to guarantee that such person replaces the tree so removed with another tree of at least two inch (2") caliper of the variety permitted in the village's subdivision ordinance. The escrow amount shall be returned to such person when the replacement tree has been planted. However, if such person does not replace the removed tree within six (6) months after removal, then the entire escrow amount shall be forfeited for the village to purchase and replace the tree. The village may waive the requirement of the escrow or tree replacement if the village board determines that circumstances exist as to warrant such waiver. (Ord. 1185, 4-22-2013)
