3-12-3: LICENSE:
   (A)   Required: It shall be unlawful to engage in the business of operating a taxicab in the village without first having secured a license from the village.
   (B)   Application: Application for a license under this section shall be made in writing to the village clerk, and shall state thereon the name of the applicant, the intended place of business and the number of cabs to be operated. If the applicant is an entity, the names and address of the president and secretary thereof or members shall be given.
   (C)   Causes For Denial: No license shall be issued to or held by any person who is not a person of good character, nor shall such license be issued to or held by any corporation or entity if any officer or member thereof would be ineligible for a license under the foregoing conditions. A person is presumed to be not of good moral character if such person has been convicted of any felony, or any misdemeanor pertaining to this type of business, within five (5) years preceding filing of the application. Upon denial of the license, the applicant may request a hearing before the board of trustees. Ten (10) days' notice of the hearing shall be given the applicant. At such hearing the applicant or the applicant's attorney may present and submit evidence of witnesses in defense.
   (D)   Fee; Issuance Of Tags Or Stickers:
      1.   The annual fees, payable in advance, for licenses under this section shall be two hundred fifty dollars ($250.00) plus one hundred dollars ($100.00) for the first taxicab and twenty five dollars ($25.00) for each additional taxicab operated. Whenever the number of cabs so operated shall be increased during the license year, the licensee shall notify the clerk of such change and shall pay the additional fees applicable thereto. All fees shall be paid on or before May 1 and will be valid through April 30 of the year after issuance. License fees shall not be prorated irrespective of the date of their issuance.
      2.   Such fee shall be in lieu of any other vehicle fee required by ordinance and the clerk shall issue suitable tags or stickers for the number of cabs covered by each license. Such tag or sticker shall be displayed in a prominent place on each taxicab while it is in use, and may be transferred to any taxicab put into service to replace one withdrawn from service.
      3.   The licensee shall notify the clerk of the motor number and state license number of each cab operated and of the corresponding village tag or sticker number.
      4.   Renewal fee for replacement tags or stickers shall be five dollars ($5.00).
   (E)   Revocation: The village president may revoke the license of any licensee for violation by the operators of any licensed vehicle of village ordinances or state laws pertaining to this chapter. The license may be revoked by the village president after written notice to the licensee, which notice shall specify the ordinance or law violations with which the licensee is charged, if after a hearing by the corporate authorities the licensee is found to be guilty of such violations. Ten (10) days' notice of the hearing shall be given the licensee. At such hearing the licensee and licensee's attorney may present and submit evidence of witnesses in defense. (Ord. 1166, 10-8-2012)
