3-3-6: FILLING OR SERVICE STATIONS:
   (A)   Defined: The term "filling station" or "service station" as used in this section is hereby defined as meaning any building, structure, premises, enclosure or other place within the village where a container or containers, tank or tanks, either portable or stationary, and containing flammable liquids, are kept or located for the purpose of selling, offering for sale, or distributing any such liquids from such container or tank.
   (B)   License Required: No person shall engage in the business of operating a filling station within the village without first having obtained a business license.
   (C)   Certain Private Gasoline Storage Tanks Exempt From License Fee: Any person maintaining or operating any storage tank in excess of twenty (20) gallons of gasoline or motor fuel for his own use shall comply with all of the provisions of this section other than the requirements for the payment of a business license fee.
   (D)   Application; Inspection Of Premises: An application for a business license shall be made in conformity with this title. The applicant shall also specify the capacity in gallons of every container or tank installed or to be installed upon the premises and the installation and the tanks shall conform to all municipal, county, state and federal regulations.
Every such application shall be investigated by the village to determine whether the applicable provisions of this chapter are being complied with, and the approval of such officer shall be noted thereon before a license shall be issued.
   (E)   Smoking Prohibited: It shall be unlawful for any person to smoke or permit smoking in the immediate vicinity of gasoline pumps.
   (F)   Flammable Liquids: Gasoline, benzol, naphtha and other flammable liquids shall not be used for washing or cleaning purposes within any filling station or in the open air within a distance of fifty feet (50') of any repair pit or any opening from any basement space.
   (G)   Waste Disposal: Waste oil or other flammable liquids shall be stored in sealed containers pending removal from the premises. No such waste shall be permitted to drain into any sewers or stormwater drainage system. Rags and soiled waste shall be kept in sealed containers.
   (H)   Conformity To Fire Prevention Code: The construction and equipment of filling stations, including tanks and the requirements for safety clearances around same, shall be made and maintained in accordance with the provisions contained in the village ordinances regulating buildings and flammable liquids.
   (I)   Cleanliness Of Premises: All filling stations or service stations shall be kept neat and clean and free of rubbish and trash. (Ord. 1166, 10-8-2012)
