§ 151.005 APPLICABILITY.
   (A)   All regulated activities and all activities that may affect stormwater runoff, including land development and earth disturbance activity, are subject to regulation by this chapter; and this chapter shall apply to all areas of the township including, but not limited to, the Tohickon Creek Watershed and the East Branch Perkiomen Creek Watershed.
   (B)   This chapter shall apply to temporary and permanent stormwater management facilities constructed as part of any of the regulated activities listed in this section. Stormwater management and erosion and sedimentation control during construction activities that are specifically not regulated by this chapter shall continue to be regulated under existing laws and ordinances.
   (C)   This chapter contains stormwater management performance standards and design criteria that are necessary or desirable from a watershed-wide perspective. Stormwater management design criteria (e.g. inlet spacing, inlet type, collection system design and details, outlet structure design and the like) shall also be regulated by applicable existing laws and ordinances.
   (D)   The following activities are defined as regulated activities and shall be regulated by this chapter, except as exempted by § 151.006:
      (1)   Subdivision and land development;
      (2)   Prohibited or polluted discharges;
      (3)   Alteration of the natural hydrologic regime;
      (4)   Subsequent to October 19, 2020 (the effective date of this chapter), the construction of additional impervious surfaces (e.g. driveways, parking lots and the like) and/or construction of new buildings/additions to existing buildings, which, solely and/or cumulatively (refer § 151.006(B), results in more than 1,000 square feet of additional impervious surface;
      (5)   Diversion or piping of any natural stream channel;
      (6)   Installation of BMPs and stormwater management facilities or appurtenances thereto; and
      (7)   Temporary storage of impervious or pervious material (rock, soil and the like) where ground contact exceeds 5% of the lot area or 5,000 square feet (whichever is less), and where the material is placed on slopes exceeding 8%. (Based on Pennsylvania Department of Environmental Protection (DEP) stock piling regulations, maximum stockpile height is 35 feet, with maximum side slopes of a ratio of two to one (2:1).)
   (E)   On residential lots of one acre or less, any proposed individual home construction projects, accessory structures projects and/or other projects involving the construction or installation of impervious surfaces, which, solely and/or cumulatively, propose from 500 square feet up to 1,000 square feet of additional impervious surface, shall either comply with the stormwater management requirements set forth in §§ 151.025 through 151.035, or utilize the simplified procedure set forth within Appendix I to this chapter to meet the requirements of this chapter. Such projects are not required, however, to submit formal SWM site plans to the township. This procedure may not be utilized in conjunction with or concerning any proposed subdivision or land development.
