(A) The rental of a rental property without a valid rental license from the township constitutes a violation of this chapter, which violation may be enforced by the issuance of a non-traffic citation to the owner of the subject rental property. The fine for such a violation shall be not less than $300 and not more than $1,000. Each day for which a rental property is rented without a license shall constitute a separate violation.
(B) The rental or continued rental of a rental property after the issuance notice of rental license revocation constitutes a violation of this chapter, which violation may be enforced by the issuance of a non-traffic citation to the owner of the subject rental property. The fine for such a violation shall be not less than $300 and not more than $1,000. Each day for which a rental property with a revoked rental license is rented without a license shall constitute a separate violation.
(C) The issuance of a disruptive conduct report constitutes a violation of this chapter, which violation may be enforced by the issuance of non-traffic citations to the owner and/or occupant of the subject rental property. The fine for such a violation shall be not less than $100 and not more than $1,000. Each disruptive conduct report that is issued concerning a rental property shall constitute a separate violation.
(D) Failure by owner to order the vacation of or failure by occupant to vacate a rental property within 30 days of the issuance of a notice of rental license revocation constitutes a violation of this chapter, which violation may be enforced by the issuance of non-traffic citations to the owner and/or occupant of the subject rental property. The fine for such a violation shall be not less than $100 and not more than $1,000. Each day for which a rental property with a revoked rental license is not ordered to vacate or not vacated in accordance with the provisions of this chapter shall constitute a separate violation.
(E) The issuance or non-issuance of a non-traffic citation under this section shall not affect or foreclose upon the authority of the township to institute a complaint in law or equity in the Court of Common Pleas concerning compliance with the provisions of this chapter.
(F) In addition to the remedies and penalties provided above, the township, at its sole discretion, may refuse to issue a rental license for a rental property that has been cited for being rented without a valid rental license for up to one year after the rental property has been vacated by the violating occupant(s). Likewise, the township, at its sole discretion, may refuse to issue a rental license for a rental property that has been cited for being rented during the 12-month period the property’s rental license is revoked for up to one year after the rental property’s original 12-month revocation period has been completed.
