§ 95.05 BOCA BASIC NATIONAL BUILDING CODE.
   (A)   Adoption by reference. The BOCA Basic National Building Code, latest edition and latest Accumulative Supplement published by the Building Officials and Code Administrators International, Inc. and the CABO One- and Two-Family Dwelling Code, latest edition published by the Council of American Building Officials are hereby adopted as the building code of the township, pursuant to the provisions of § 702, Clause LI of the Pennsylvania Second Class Township Code, 53 P.S. §§ 65101 et seq., Act of May 24, 1933, P.L. 103, as amended, 53 P.S. § 65751.
   (B)   Interpretation. The provisions of this section shall be held to be minimum requirements for the promotion of the health, safety and welfare of the residents of the township. Where the provisions of this section impose greater restrictions than those of any other ordinance, law or regulation of the township, county or the commonwealth, the provisions of this section shall be controlling. Where the provisions of such other ordinances, laws or regulations impose a greater restriction that this section, the provisions of such other ordinance, laws or regulations shall be controlling.
   (C)   Exclusions. Exempted from the provisions of this Building Code shall be accessory prefabricated buildings which do not house people or animals and which are erected on site or delivered erected to the site and installed without masonry or pole type foundation below ground surface and not exceeding 100 square feet.
   (D)   Insertions. The words “Township of Bedminster” and “Pennsylvania” inserted in the appropriate places throughout the Code.
   (E)   Fees. Before receiving a building permit, the owner or his or her agent shall pay to the township a fee based upon the schedule attached to Ord. 41.
   (F)   Appeals. The appeal procedure of the BOCA Code and the CABO Code are superseded by the following procedures.
      (1)   Appeals from the decision of the Building Official. Any party interested may appeal from the decision of the building official by notifying the Secretary of the Board of Township Supervisors in writing of his or her intention to appeal. Such notice of intention shall be filed with the Secretary of the Board of Township Supervisors within 30 days of the date of the decision appealed from. The Board of Supervisors shall promptly set a hearing date at which the appellant may be heard. The Township Supervisors shall thereupon, in consultation with the Township Engineer, either affirm, reverse or modify the decision of the building official. The decision of the Board of Supervisors shall be final.
      (2)   Fee for appeal. A party appealing a decision of the building official shall pay a fee on costs in the amount of $500. Said fee may be changed from time to time by resolution of the Board of Township Supervisors.
