(A) Sewage management permits.
(1) In accordance with § 91.04, an individual or community sewage system shall not be installed nor shall any building that produces sewage be occupied until a sewage management permit has been issued by the township. The applicant for a building permit or any proposed subdivision or land development that will utilize a sewage system shall submit to the township an application for a sewage management permit concurrently with the building permit, subdivision/land development application, or planning module application, as appropriate. Any repairs or replacement of existing sewage systems shall also be subject to the requirements of this subchapter and require a sewage management permit if such work is being proposed to accommodate increased sewage flows or a change of use of the property. If no change in use or increase in sewage flows are proposed, no permit is required for repair or replacement of any existing system.
(2) The following requirements shall also be complied with.
(a) Building and zoning permits shall not be issued for any structure or parcel to be serviced by a sewage system, prior to the issuance of a sewage management permit for that system.
(b) All individual sewage system components including, but not limited to, absorption areas must be located on the same parcel as the structure they will serve. Systems or components cannot be located on a separately deeded parcel, regardless of the parcel’s ownership, or through means of an easement, right-of-way or other instrument.
(c) The township and its agents shall have the right to enter the premises of any property owner applying for or holding a sewage management permit to inspect the construction and/or operation of the system, and if the system is not being constructed or operated according to the permitted design, issue a stop work order or revoke the occupancy permit until construction or operation is brought into compliance with the sewage management permit.
(d) No sewage system shall be altered, extended, augmented or modified without the issuance of a sewage management permit.
(e) No sewage system shall be used or loaded in a manner which is inconsistent with the sewage management permit that was issued to authorize that system’s installation.
(f) Applications for sewage systems that employ or contain electronically, mechanically, hydraulically or pneumatically operated or controlled devices shall be accompanied by the respective manufacturer’s recommended maintenance schedule and product specifications.
(g) When required by this subchapter, applications shall include a fully executed O&M agreement with the township in a township approved form.
(B) Pumper registration. At least seven days before offering pumping and/or inspection services to property owners that will enable their compliance with the terms of this subchapter, all pumpers shall:
(1) Comply with all reporting requirements established herein;
(2) Provide proof of license from the BCDH;
(3) Document membership in the Pennsylvania Septic Management Association;
(4) Document that there is at least one employee/owner/operator certified by the Pennsylvania Septic Management Association to perform on-lot wastewater treatment inspections;
(5) Operate in a manner consistent with the provisions of the Pennsylvania Solid Waste Management Act (Act 97 of 1980), 35 P.S. §§ 6018.101 through 6018.1003; and
(6) Provide documentation that all septage pumped from properties in this township will be delivered to and disposed at a DEP-approved site or facility.
