(A) When a utility customer has not timely challenged all or part of a monthly billing, pursuant to § 52.01, and the customer has become 30 days delinquent in the payment of the account, the Utility representative shall initiate the termination of utility service by attempting notification by phone, cell phone, text messaging, e-mail, or mailing to the customer a notice of termination.
(B) Where a utility customer has challenged a billing pursuant to § 52.01, and the matter has been finally resolved by either the Utility Director or the Utility representative, the Utility representative shall, within five days after the final decision is issued, mail to the customer a notice of termination.
(C) The notice of termination shall contain the following information.
(1) The date the notice of termination was issued.
(2) The date on which a termination of utility service shall occur. The date of termination shall be at least five calendar days after the date on which the notice of termination was issued.
(3) A statement that, unless the Utility representative receives full payment on the account the notice was issued prior to the date of termination, utility service will be terminated.
(4) The telephone number of the Utility Billing Office.
(5) A reference to the pamphlet of the rules furnished to the customer.
(D) If, prior to the date of termination, the utility has not received complete payment of the amount on the account, and the customer has not requested the establishment of a deferred payment plan, then the Utility representative shall terminate utility service provided to the customer on the date of termination.
(E) Offers, by customers, of partial payment, other than under a deferred payment plan provided for in this section, shall be rejected. If the Utility representative received payment of the entire amount shown on the account prior to the date of termination, the payment shall be considered timely and shall halt the termination process.
(F) A service fee pursuant to § 50.20 will be charged once the service representative leaves the utility office with the certified shut-off list.
(G) The following limitations shall apply to use of the utility termination procedure. Utility service shall be terminated between the hours of 8:00 a.m. and 3:00 p.m., and only on a day that the utility office is open to the public. Also, service may not be disconnected for nonpayment after noon of the day before any day that the utility office is closed to the public. (In other words, if a utility’s offices are closed on a particular Friday, it can not disconnect service after noon on the Thursday before.)
