§ 33.253 FIRE PREVENTION AND WORKPLACE HAZARDS.
   (A)   Smoking allowed only in designated areas. "Smoking" means the carrying or holding of a lighted cigarette, cigar, pipe, or any other lighted smoking equipment, or the inhalation or exhalation of smoke from any lighted smoking equipment. The official in charge of a public building shall designate a nonsmoking area and may designate a smoking area in the building. When smoking and nonsmoking areas are designated, the official in charge of a public building may take reasonably necessary measures to accommodate both smokers and nonsmokers. If a public building consists of a single room, any part or all of the room may be reserved and posted as a nonsmoking area. A person who smokes in a public building, except in an area designated as a smoking area commits a Class B infraction. However, the violation is a Class A infraction if the person has at least three previous unrelated judgments for violating this section that are accrued within the 12 months immediately preceding the violation. The official in charge of a public building shall do the following:
      (1)   Post conspicuous signs that read "Smoking Is Prohibited By State Law Except In Designated Smoking Areas" or other similar language;
      (2)   Request persons who are smoking in violation of this section to refrain from smoking; and
      (3)   Remove a person who is smoking in violation of this section and fails to refrain from smoking after being requested to do so.
   (B)   It is the responsibility of all employees to prevent any type of fire in the building. Listed below is a list of general items to take into consideration to accomplish this objective:
      (1)   Extinguish all cigarettes in their proper place;
      (2)   Do not have open flame around any type of chemicals, paints, solvents, or flammable liquids;
      (3)   Make sure all hand held torches are extinguished when not in use; and
      (4)   Do not put any type of hot object in trashcans; i.e. cigarette butts.
   (C)   Listing of some workplace hazards:
      (1)   Flammable substances;
      (2)   Paint and paint solvents;
      (3)   Mineral spirits;
      (4)   Alcohol;
      (5)   Propane tanks for fork trucks;
      (6)   Oxygen and acetylene tanks;
      (7)   Hydraulic oil;
      (8)   Grease; and
      (9)   Welding operations. All welding operations will be done in a confined area unless otherwise instructed by the Department Head. A fire extinguisher will be immediately available in case of an emergency.
