To promote sidewalks and encourage landowners to replace unsafe sidewalks and retaining walls, the Street Department has developed a sidewalk/retaining wall program for landowners in the city. The city will remove existing public sidewalks and retaining walls (two feet tall or less) at a landowner's request and provide the materials to install new sidewalks to the landowner. The city will not provide materials to construct new retaining walls. To qualify for the city's sidewalk/retaining wall program, the landowner must agree to the following conditions:
(A) All sidewalks must be open to the public and be constructed pursuant to the city's specifications.
(B) Any retaining walls must be located adjacent to a public sidewalk or city street and must be constructed pursuant to the city's specifications.
(C) The landowner shall be responsible for hiring and paying a qualified contractor to construct the new walk or retaining wall.
(D) Contractors must be qualified to perform sidewalk or retaining wall construction.
(E) Contractors who wish to participate in this program must furnish references for sidewalks or retaining walls constructed at other locations.
(F) The amount of concrete furnished by the city will be determined by a formula multiplying the length, width and depth of the sidewalk to be constructed, not to exceed 100 linear feet. Any additional concrete required due to a contractor's failure to maintain the proper depth with stone will be at the expense of the contractor. The Street Commissioner will approve the measurements of the material to the supplier.
(G) The city is not responsible for concrete poured during inclement weather or during weather considered to be unfavorable for construction.
(H) Payment for the contractor's labor is strictly between the landowner and contractor.
(I) The city will furnish concrete for the portion of a drive entrance that is used for pedestrian traffic and will not exceed the width of the adjoining sidewalk.
(J) Material furnished for sidewalks will be limited to concrete only.
(K) All work done by the city to remove the old sidewalk or retaining wall will be done as soon as possible. However, the contractor should coordinate the work done with the Street Commissioner or their designated representative to allow scheduling. All work must be completed within 14 days after the removal of the sidewalk or retaining wall. This may be extended if approved by the Street Commissioner or his or her representative.
(L) Boundary lines must be marked by the landowner before sidewalks or retaining walls are removed.
(M) The city will not provide concrete for retaining walls, only for sidewalks.
(N) Concrete shall be furnished by the city's supplier.
