§ 97.04 RETAINING WALLS.
   (A)   For purposes of this chapter, a RETAINING WALL is a wall that is built to keep the land behind it from sliding. RETAINING WALLS are accessory structures designed to restrain soil to a slope that it would not naturally keep.
   (B)   No person, having the control, management, possession, or ownership of any lot, tract, or parcel of ground within the city, along and adjoining which any retaining wall extends to support said property, shall permit or allow the retaining wall to deteriorate to an unsafe accessory structure.
   (C)   If a retaining wall is an unsafe accessory structure, the landowner shall repair the retaining wall within 60 days of receiving written notice by the city. The landowner must also obtain a building permit application through the city's Planning Department office located at 1102 16th Street, Bedford, IN 47421 before any repairs are performed to retaining walls four feet or higher.
