No person shall drive a taxicab while intoxicated, or indulging in or having indulged in intoxicating liquor or beverage. No operator of a taxicab business shall permit any person who is intoxicated, who has been drinking intoxicating liquor or beverage, or who has the smell or odor of intoxicating liquor or beverage upon his or her breath, to drive a taxicab.
