951.09 REMOVAL OF CONTAINERS FROM TREE LAWN AND FRONT YARDS.

   (a)   Garbage, rubbish and refuse cans and/or containers shall be removed from the tree lawn area (or point of collection as defined in Section 951.05(e)) and/or the front of the property where said cans and containers have been placed and/or any area of the lot visible from the public right-of-way in front of the residence or other structure from which the City or its contractor has collected the garbage by 6:00 p.m. on the day immediately following the day upon which the garbage, rubbish and refuse was collected by the City of Bedford Heights and/or the garbage collection firm with which the City has contracted for the removal of such garbage, rubbish and refuse.

   (b)   Whenever subsection (a) hereof has been violated, the Director shall comply with the procedure outlined in Sections 951.07(b)(1), (b)(2) and (b)(3).

   (c)   Whoever violates any provision of subsection (a) hereof or participates in such violation shall be guilty of a minor misdemeanor and subject to a fine of up to one hundred fifty dollars ($150.00). Each day such violation continues shall constitute a separate offense.
