917.16 BACK FLOW PREVENTION PROGRAM.
   The City hereby establishes a “Back Flow Prevention Program” to aid in preventing backups in a dwelling’s sanitary sewers during heavy rain events. Residents who reside in a qualifying dwelling may make application to the City for reimbursement towards the cost of a device known as a back-flow preventor.
   (a)   A “qualifying dwelling” for the purposes of this section is a dwelling that has a history of backups of the sanitary sewer on the premises during heavy rain events as determined by the Director of Water Reclamation.
   (b)   The resident of a qualifying dwelling shall be responsible for the initial purchase and cost of the back-flow preventor, but will be entitled to reimbursement of such cost subject to the terms of subsection (i) herein. The resident shall be responsible for any and all costs related to the installation of said device. The resident shall be responsible to hire his/her own contractor for installation.
   (c)   Back-flow preventors shall not be furnished for slab (basement-less) homes.
   (d)   Residents shall agree to take responsibility for maintaining the check valve of the back-flow preventor.
   (e)   A “qualifying dwelling” shall be eligible to receive reimbursement for the purchase of a back-flow preventor only once per property regardless of transfer of ownership of the property.
   (f)   The City will reimburse the homeowner for an outside-installed check valve back-flow preventor. The resident of a qualifying dwelling shall receive reimbursement for the purchase of a back-flow preventor device up to a maximum of three hundred fifty dollars ($350.00). The resident shall present a receipt showing the purchase of the device.
   (g)   The resident shall obtain all necessary inspections and building permits required for the installation of the back-flow preventor. The City shall also provide the resident with a list of approved back-flow preventor devices. The resident shall also make application for a permit for installation of the back-flow preventor to the Building Commissioner or his or her designee and the Building Department shall make an inspection after installation to determine whether or not the device has been properly installed. After said inspection and upon approval of the Building Commissioner or his or her designee, the resident shall receive reimbursement from the City.
   (h)   The City can supply a list of contractors to the resident; however, the contractor’s performance warranty or guarantee will be to the homeowner and will stay with the property. The City assumes no responsibility for the quality of workmanship of the contractor hired by the resident. The City assumes no responsibility for any guarantee or warranty for either the back-flow preventor device or the workmanship of the contractor hired by the resident.
   (i)   Prior to the issuance of a permit for the installation of the back-flow preventor, the owners of properties adjacent to the qualifying dwelling shall be notified by the City of the application for the installation of the back-flow preventor.
   (j)   Prior to the issuance of a permit for the installation of the back-flow preventor, the City Engineer shall issue a hydrologic report to the Water Reclamation Director as to the possible impact of the installation of the back-flow preventor on neighboring properties. No permit will be issued if the City Engineer determines that the installation of the back-flow preventor in a qualifying dwelling will have a substantial and adverse effect on the drainage of neighboring properties.
