139.01 ESTABLISHMENT; DIRECTION AND CONTROL.
   (a)   There is hereby established the Division of Building, Engineering and Inspection which shall be directed and controlled by a Building Official duly-certified by the State of Ohio as required to meet the requirements for certification as a Residential Building Department to enforce the Residential Code of Ohio for One, Two, and Three-Family Dwellings as well as a Nonresidential Building Department under Chapter 3781 of the Ohio Revised Code.
   (b)   He or she shall be appointed by the Mayor with confirmation of City Council. He or she shall serve at the pleasure of the Mayor. Compensation for said position shall be determined from time to time by Council.
   (c)   Notwithstanding the provisions of subsection (b) above, the Mayor, with the authorization and approval of Council, may contract for Building Department services to provide the City with a duly-certified Building Official and certified inspector so as to meet the requirements of the State of Ohio for certification as a Residential Building Department necessary to enforce the Residential Code of Ohio for One, Two and Three-Family Dwellings as well as a Nonresidential Building Department under Chapter 3781 of the Ohio Revised Code.
   (d)   Whenever the term “Building Commissioner” is used in the Codified Ordinances of the City of Bedford Heights, Ohio, said term shall also mean a duly-certified “Building Official” who shall perform all the duties and have all the powers of the “Building Commissioner” as outlined in the Codified Ordinances. The terms Building Commissioner, Building Official and Zoning Inspector shall be synonymous.
