133.07 TOOL LOAN PROGRAM.
(a) There shall be and is hereby instituted a program of purchase of certain tools and equipment to be acquired by and kept under control of the Director of Public Service for loan to residents of the City specifically for use in home maintenance projects.
(b) The Director is hereby authorized and directed from time to time to purchase those tools and equipment which would be most useful and necessary to residents in home maintenance projects including, but not limited to, such tools as saws, drills, spray guns, sanders, ladders and other similar type hand tools.
(c) The Director is hereby authorized and directed to prepare proper application forms to be completed by residents of the City which form shall indicate the name and address of the applicant; the type of project to be undertaken; and the tool or tools desired to be used.
(d) The Director is further authorized and directed to adopt reasonable rules and regulations for the use of such tools and equipment including provision for a limitation on the amount of time of the loan, the amount of security deposit to be refunded upon return of the tools or equipment in good condition, notification of a requirement that unreturned tools or equipment shall be cause for the applicant to pay the cost of replacement of the same, and such other reasonable and necessary regulations for the entire program.
(e) Nothing contained in this legislation or in the program shall relieve the requirement of an applicant to obtain any necessary or proper permits from the Division of Building where the same are required by the ordinances of the City.
(f) The Director shall prepare a notice to each applicant that the City assumes no responsibility for any injury or damage caused by the use or misuse of any tool or equipment loaned to the applicant; that the City makes no representation or warranty regarding the tool or equipment loaned; that any person requesting the use of the tool or equipment assumes any and all risks connected with the use of the same; and that the person to whom the tool or equipment is loaned shall hold the City harmless from any and all claims arising in connection with the use of such tool or equipment.
