1177.07 APPEALS TO PLANNING COMMISSION; REFERRAL OF APPEALS BY PLANNING COMMISSION TO ZONING BOARD OF APPEALS OR COUNCIL.
   Any person adversely affected by a decision of any City official made in the enforcement of this chapter shall have the right to appeal to the Planning Commission from such decision within ten (10) days from the date notice of such decision was given or mailed to him or her. Such appeal must be in writing. Failure to file a written appeal with the Planning Commission within the time prescribed shall constitute a waiver of the right of appeal. The Planning Commission has the discretion to hear the appeal at a time and place fixed by the Commission or to refer the appeal to the Zoning Board of Appeals or to Council within thirty (30) days of the filing of the appeal for hearing and decision upon the appeal. The Planning Commission (or the Zoning Board of Appeals or Council upon referral by the Planning Commission) shall have the power to approve, amend, modify, reverse or vary any decision of such City official or the terms of this chapter.
