1375.02 APPLICATION INFORMATION.
   (a)    Application for an occupancy permit required by Section 1375.01 shall be made by the seller, lessors or their agent not less than thirty days prior to the transfer of title or possession. Such application shall include the following information:
      (1)    The street address of the structure or the specific address of the parts or part if the entire structure is not involved.
      (2)    The name, address and phone number of the owner or agent in charge and where such person may be reached during normal business hours.
      (3)    An indication as to why the application is being requested, i. e.:
         A.    Direct sale;
         B.    Rental;
         C.    Lease or combination; or
         D.    Land contract.
      (4)    The proposed date of occupancy.
      (5)    The name, address and telephone number of the prospective purchaser, or tenant, his agent or representative. If the prospective purchaser or tenant is unknown at the time application for occupancy permit is made, the seller, lessors or their agent shall supply such information to the Building Commissioner as soon as it is known, but, in any event, before the issuance of an occupancy permit pursuant to the provisions of this chapter.
   (b)    The seller, lessor or their agent shall, within five days of making an application for an occupancy permit, advise in writing the prospective purchaser or tenant of the fact of applying for the same. In the event of sale through an escrow agent, the seller or his agent shall also advise in writing the escrow agent of the fact of applying for an occupancy permit.
   (c)    Failure to apply for an occupancy permit within the time and in the manner herein prescribed shall constitute a violation of the Housing Code and subject the seller, lessor or agent to the penalty set forth therein.
