1337.02 PERMIT; REQUIREMENTS.

   Notwithstanding any provisions to the contrary in these Codified Ordinances, the Building Commissioner is authorized to issue a permit after proper application for the installation of a hard-surface, dust-free patio or a deck in the rear yard only of any single-family or two-family residence in the City. In addition to complying with all other applicable laws, ordinances and regulations pertaining thereto, such patio or deck must also meet the following requirements:

   (a)   The maximum area shall 600 square feet.

   (b)   (1)   No part of the pavement or deck shall be constructed within three feet of a driveway or other facility for the parking of automobiles; or

      (2)   That part of the pavement or deck to be constructed which does not otherwise qualify under (b)(1) immediately above shall be separated from the nearest driveway or other facility by a curb or barrier not less than six inches high with a three foot wide walk-through opening.

   (c)   No part of the pavement or deck shall be constructed within the required side yard area.

   (d)   Criteria for Patio Inspections shall be the same as specified for Driveways under Section 907.03 of the City Codified Ordinances.
