1171.12 REFUSAL OF PERMIT.

   No permit shall be issued for the construction, remodeling or rebuilding of any service station or filling station where the applicant for the permit is the owner or the agent of the owner of another existing service station or filling station within the corporation boundaries of the City which is an abandoned station, as defined in Section 1171.11(a), or where there are any current violations of which notice has been issued by the appropriate official of the City against such service station or filling station prior to the date of the application for such permit. For the purpose of determining these facts, the Building Commissioner may require the submission of an affidavit by the owner with the application for a permit, listing therein the locations of existing service stations and/or filling stations under his ownership.
