1131.05 CERTIFICATE OF OCCUPANCY.
   (a)    Certificate Required. No owner, lessee or tenant shall occupy any structure, building or land, or part thereof, hereafter erected, created, changed, converted or enlarged, unless a certificate of occupancy has been issued by the Zoning Inspector after inspection.
 
   (b)    Certificate of Occupancy of Land. A certificate of occupancy for the use of vacant land, or change in the use of land as herein provided, shall be applied for before any such land shall be occupied or used, and a certificate of occupancy shall be issued within ten days after the application has been made therefor, provided such use is in conformity with the provisions of this Zoning Code and other applicable regulations.
   (c)    Certificate of Occupancy of a Building. A certificate of occupancy for the erection of a new building or for the alteration of an existing building shall be applied for at the same time as the application for a building permit and the certificate shall be issued only after the erection or alteration of the building or a component thereof has been completed and found, by inspection, to be in conformity with the provisions of this Zoning Code. The applicant for a building permit, the owner and/or his agent shall be held responsible for completing the work until the certificate of occupancy is issued, provided that pending the issuance of a regular certificate, a temporary certificate for partial occupancy of a building may be issued for a period not to exceed 120 days, during which time alterations are being made or a dwelling completed.
   (d)    Change in Use of Conforming Building or Land. A certificate of occupancy shall be required for the use of vacant land or for a change in the use of a conforming building or land and a certificate shall be issued when found by inspection to be in conformity with the provisions of this Zoning Code.
   (e)    Change in Use of Nonconforming Building or Land. A certificate of occupancy shall be required and issued whenever a nonconforming use of a building or land, if approved by the Board of Zoning Appeals, is changed to either a conforming use or a more restrictive nonconforming use.

   (f)   Contents of Certificate. The certificate of occupancy shall state that the building or proposed use of a building or land complies with all the building and health laws and applicable ordinances, with all conditions and requirements stipulated by the Board of Zoning Appeals, and with the provisions of this Zoning Code. A record of all certificates shall be kept on file in the office of the Zoning Inspector and copies shall be furnished, on request, to any persons having a proprietary or tenancy interest in the building or land affected. The fee for an original certificate as provided above shall be ten dollars ($10.00)each, and shall be included in the building permit fee. The fee for copies of any original certificate shall be one dollar ($1.00) each.

   (g)    Certificate of Use and Occupancy; When Effective. A certificate of use and occupancy shall remain in effect as long as the use of such building or land is in full conformity with provisions of this Zoning Code and with any conditions upon which such certificate was issued. Upon the service of notice of any violation of the provisions or conditions of this Zoning Code or any other applicable ordinance, the certificate of use and occupancy shall become null and void and a new certificate shall be required for any further use or occupancy of such building or land.
