373.18 RENTAL AGENCIES AND DEALERS.

   (a)   A rental agency shall not rent or offer any bicycle for rent unless the bicycle is licensed and a license tag is attached thereto as provided herein and unless such bicycle is equipped with the lamps and other equipment required in this chapter.

   (b)    Every person engaged in the business of buying or selling new or secondhand bicycles shall make a report to the Division of Police of every bicycle purchased or sold by such dealer, giving the name and address of the person from whom purchased or to whom sold, a description of such bicycle by name or make, the frame number thereof and the number of the license tag, if any, found thereon, within seven days of the date of the transaction.

   (c)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
