§ 154.105 RELIEF FROM PERSONAL RESPONSIBILITIES.
   (A)   Any person charged with the enforcement of this subchapter, while acting for the borough, shall not thereby render himself or herself personally liable, and he or she is relieved hereby from all personal liability for any damage that may accrue to persons or property as a result of any act required or permitted in the discharge of his or her duties.
   (B)   Any suit instituted against any officer or employee because of an act performed by him or her in the lawful discharge of his or her duties shall be defended by the legal representative of the borough.
   (C)   In no case shall any such officer or employee be liable for costs in any action or suit or proceeding that may be instituted in pursuance of the provisions of this subchapter when he or she performs his or her duties in good faith and without malice.
   (D)   For the purposes of this subchapter, any person who has been assigned duties by Borough Council pursuant to this subchapter shall be considered an employee of the borough and shall be entitled to the provisions of this section.
