(A) Upon receipt of the written counsel of the Board as provided in § 154.098(E)(6), Borough Council shall consider at a regular or special meeting the question of issuing to the Zoning Permit Officer a certificate of appropriateness authorizing a permit for the work covered by the application.
(B) The applicant shall be advised by the Borough Secretary of the time and place of the meeting at which the application will be considered and shall be advised that he or she has the right to attend to be heard as to his or her reasons for filing the same. In determining whether or not to certify the appropriateness of the proposed erection, reconstruction, alteration, restoration, demolition, or razing of all or a part of any building or structure within any Historic District, Borough Council shall consider the same factors as the Board of Historical Architectural Review set forth in § 154.098(E)(3) and the report of the Board.
(C) If Council approves the application, it shall issue a certificate of appropriateness authorizing the Zoning Permit Officer to issue a permit for the work covered. If Council disapproves, it shall do so in writing and copies shall be given to the applicant and to the state’s Historical and Museum Commission.
(D) The disapproval shall indicate what changes in the plans and specifications would meet the conditions for protecting the distinctive historical character of the district. In either case, Borough Council shall notify the applicant of its decision, in writing, within 30 days of its receipt of the application.
(E) Should Borough Council fail to so notify the applicant, it shall be assumed, as a matter of law, that the application is approved, unless the applicant waives the time limit in writing.
