For the purpose of this subchapter, all words used in the present tense include the future tense. All words in the plural number include the singular number and all words in the singular number include the plural number, unless the natural construction of the word clearly indicates otherwise. The word “shall” is mandatory and not directory. The word “used” includes “designated, intended, built, or arranged to be used.”
ALTERATION. Any change modification, or addition to a part of or all of the exterior of any building or structure.
BEDFORD HISTORICAL ARCHITECTURAL REVIEW BOARD. The agency established by this subchapter to advise Borough Council on any requests for authorization to construct, alter, reconstruct, repair, restore, or demolish all or a part of any building or structure within a Historic District. Also referred to as the BEDFORD BOARD OF HISTORICAL ARCHITECTURAL REVIEW.
BOARD. The Bedford Board of Historical Architectural Review.
BOROUGH. The Borough of Bedford.
BOROUGH COUNCIL. The governing body of the Borough of Bedford.
BOROUGH SECRETARY. The Secretary of the Borough of Bedford.
BUILDING. Any enclosed or open structure which is a combination of materials to form a construction for occupancy and/or use, including mobile homes and trailers, to be used for any reason whatsoever.
CERTIFICATE OF APPROPRIATENESS. The approval statement signed by the Council of the Borough of Bedford which certifies the appropriateness of a particular request for the construction, alteration, reconstruction, repair, restoration, demolition, or razing of all or a part of any building or structure within a Historic District and which authorizes the issuance of a zoning permit for said request.
COMMONWEALTH. The Commonwealth of Pennsylvania.
CONSTRUCTION. Any or all work necessary for the erection of any building or structure from a combination of materials.
COUNCIL PRESIDENT. The chief executive of the Borough of Bedford.
DEMOLITION. The dismantling or tearing down of all of part of any building or structure and all operations incidental thereto.
HISTORIC DISTRICT. Any area of the Borough of Bedford created by ordinance of the borough pursuant to an Act of June 13, 1961, Pub. Law 282, No. 167, as amended and subject to the regulations contained herein.
NATION. The United States of America.
PERMIT. A certificate issued by the Zoning Permit Officer which approves the erection, reconstruction, alteration, restoration, demolition, or razing of any building or structure, in whole or in part, within any Historic District and which is subject to the provisions of this subchapter.
PUBLIC STREET OR WAY. Any land dedicated to public use or passage including, but not limited to, streets, alleys, parks, pedestrian right-of-ways, and other public rights-of-way, whether constructed, dedicated, or proposed.
RECONSTRUCTION. Any or all work needed to remake or to rebuild all or part of any building or structure to a sound condition, but not necessarily of original materials.
REPAIRS. Any or all work involving the replacement of existing work with equivalent material for the purpose of maintenance, but not including any addition, change, or modification in construction.
RESTORATION. Any or all work involved in returning a building or structure, or a part thereof, to its original condition or nearly original condition through the use of original or nearly original materials. Condition shall refer to design rather than to structural stability.
SIGN. Any device, structure, or object for visual communication, including its structure and component parts, that is used for the purpose of bringing the subject thereof to the attention of people, but not including any cloth flag of any public, quasi-public, civic, charitable, or religious group.
STATE. The Commonwealth of Pennsylvania.
STRUCTURE. Any constructed, erected, or placed material or combination of materials in or upon the ground, including, but not by way of limitation, buildings, mobile homes, radio towers, sheds, signs, and storage bins.
ZONING PERMIT. An approval statement issued by the Zoning Permit Officer or his or her designee authorizing the construction, alteration, reconstruction, repair, restoration, demolition, or razing of all or a part of any building or structure.
ZONING PERMIT APPLICATION. The request filed by any person with the Zoning Permit Officer that seeks authorization to construct, alter, reconstruct, repair, restore, demolish, or raze all of part of any building or structure.
ZONING PERMIT OFFICER. The officer of the borough designated by the Borough Council as the individual who issues the permit for construction, alteration, reconstruction, repair, restoration, demolition, or razing of all or a part of any building (within a Historic District).
