§ 154.030 CMR COMMERCIAL/MANUFACTURING/RESIDENTIAL DISTRICT.
   In the CMR Commercial/Manufacturing/Residential District, the following regulations shall apply.
   (A)   Uses permitted.
      (1)   Automobile service stations, automobile sales, trailer coach sales, service garage, auto sales lots, automobile assembling, auto body shops, painting, upholstery, reconditioning, vehicle repair or overhauling, tire retreading or recapping, welding shops, and the like;
      (2)   Bottling works and bookbinding;
      (3)   Building materials storage, lumber yards, and lumber mills;
      (4)   Blacksmith and machine shops, excluding punch press over 20 tons rated capacity, drop hammers, and automatic screw machines;
      (5)   Carpenter, cabinet making, furniture repair and upholstery, electrician, metal working, tinsmith, plumbing, gas, steam, or hot water fitting shops;
      (6)   Contractor’s equipment, sales, service, and storage;
      (7)   Laboratories and lithographing;
      (8)   Laundries, cleaning, dyeing, and carpet and rug cleaning;
      (9)   Distribution plants, parcel delivery, and service industries;
      (10)   The manufacturing, compounding, processing, or treatment of such products as bakery goods;
      (11)   The manufacture and assembling of articles or merchandise from the following previously prepared materials: cellophane; canvas; cloth; cork; felt; film; glass; leather; stone; paper; plastic; precious or semiprecious metal or shell; textile; wood; yarn; and paint not employing a boiling process;
      (12)   The manufacturing of pottery and figurines or other similar ceramic products, using only clay, and kilns fired only by electricity or gas;
      (13)   Printing and newspaper publishing;
      (14)   Freight and trucking terminals;
      (15)   Electrical and optical manufacturing;
      (16)   All uses permitted in C-1 and C-2 Commercial Districts;
      (17)   Wholesale business, warehouse, and cold storage plant;
      (18)   All uses permitted in R-4 Residential and Business/Professional Offices District;
      (19)   All uses similar to the above and not otherwise prohibited by law;
      (20)   Accessory uses and buildings customarily incidental to the above uses; and
      (21)   The above uses are permitted only on the condition that they are not obnoxious or offensive by reason of the emission of odor, dust, smoke, noise, gas, vibration, illumination, refuse matter, or water-carried waste.
   (B)   Height regulations.
      (1)   The height of a building shall be not greater than 40 feet.
      (2)   The height of a dwelling shall be not less than one story.
   (C)   Area regulations. Not applicable for commercial and manufacturing uses. For residential uses, utilize R-3 Residential District Multi-family guidelines.
   (D)   Yard regulations. Each lot shall have front, side, and rear yards of not less than the depth or width indicated below.
      (1)   Front yard depth:
         (a)   Twenty-five feet when the adjacent street, avenue, drive, lane, road, or way is greater than 20 feet in width, except for apartment dwellings; and
         (b)   Twenty feet when the adjacent street, avenue, drive, lane, road, or way is 20 feet or less in width, except for apartment dwellings.
      (2)   Side yards width:
         (a)   Ten feet each for the two side yards on an interior lot, except for apartment dwellings and attached dwellings;
         (b)   Ten feet for the one interior side yard of a corner lot, except for apartment dwellings;
         (c)   Twenty feet for the one side yard fronting along a street, avenue, drive, lane, road, or way that is not defined as a front yard, except for apartment dwellings;
         (d)   For attached dwellings on interior lots, the ten-foot side yards are only required to be adjacent to the exterior side walls of the building; and
         (e)   Provided that when a written agreement is supplied to the borough by the adjoining property owners, no side yard shall be required where two or more commercial uses abut side by side. However, in no case shall party walls be permitted between properties of separate ownership. In case of a series of abutting structures, abutting and paralleling a public right-of-way, an open and unobstructed passage of at least 20 feet in width shall be provided at grade level at intervals of not more than 400 feet.
      (3)   Rear yard depth: 25 feet, except for apartment dwellings.
      (4)   For apartment dwellings of one or two stories, there shall be a front yard(s), a side yard(s), and a rear yard, each of not less than 25 feet; provided that for each story over two, five feet of depth or width shall be added to each yard.
      (5)   See § 154.005(D) for additional provisions.
   (E)   Coverage regulations.
      (1)   The coverage shall be no more than 60%.
      (2)   At least 10% of the lot area shall be covered with vegetative material.
   (F)   Off-street parking. Parking, loading, and unloading space shall be provided in accordance with the provisions of § 154.045.
   (G)   Exceptions. Divisions (C), (D), (E), and (F) above shall not apply to additions or changes to buildings or uses existing at the time of adoption of this chapter.
