§ 30.074 PROCEDURE TO SELL OF BOROUGH PROPERTY.
   The Council of the borough authorizes the sale of personal property which is owned by the borough and valued at less than $1,000, utilizing the procedure enumerated below.
   (A)   The Manager of the borough shall provide to the Property Committee and/or Street-Equipment Committee of the Council of the borough an itemized list of personal property he or she desires to be sold.
   (B)   The Property Committee and/or Street-Equipment Committee of the Council of the borough shall determine that the personal property is no longer of use to the borough and that the estimated fair market value of each item, or lots of items, is less than $1,000.
   (C)   The Manager of the borough shall advertise for sale, in a local newspaper, those items of personal property jointly determined to no longer be of use to the borough. The advertisement shall state:
      (1)   A description of the personal property to be sold;
      (2)   The dates and times that the personal property will be available for inspection by prospective buyers;
      (3)   Any and all items so advertised are being sold “as is,” with no warranty provided by the borough as to condition or functionality;
      (4)   The buyer is responsible for the payment of any and all applicable sales tax(es);
      (5)   The personal property must be paid for by either a cashier’s check, made payable to the borough, or by cash;
      (6)   The minimum acceptable bid for any one item, if applicable;
      (7)   The due date for bid submissions;
      (8)   The date on which the sale of the item(s) will be awarded; and
      (9)   The date by which the personal property must be paid for and removed from the borough.
   (D)   The Manager of the borough and the Property Committee and/or Street-Equipment Committee of the Council of the borough shall jointly determine the award of sale of the personal property.
   (E)   The Manager of the borough shall:
      (1)   Notify the successful bidder(s) of the acceptance of their bid(s);
      (2)   Direct that successful bidder(s) deliver payment in the amount(s) of their bid(s) to the Borough Office; and
      (3)   Direct that successful bidder(s) remove the purchased items of personal property from the borough.
   (F)   The procedures set forth in divisions (C) to (E) above may be modified if the Manager of the borough and the Property Committee and/or Street-Equipment Committee of the Council of the borough jointly agree that another method of sale is in the best interests of the borough.
