(A) Borough Council shall give written notice to construct a sidewalk or curb to the property owner by certified mail, personal service, or as otherwise provided by law. The property owner shall have one year within which to comply with the notice.
(B) Borough Council shall give written notice to repair or reconstruct a defective sidewalk or curb to the property owner by certified mail, personal service, or as otherwise provided by law. Except as provided in division (C) below, the property owner shall have 60 days to comply with the notice.
(C) Where, in the opinion of Borough Council, a dangerous condition exists that can be repaired by an expenditure of $500 or less, the borough shall notify the owner to make the repairs within 48 hours. Such notice shall be served on the owner personally or by certified mail. If the owner cannot be served within the county, notice may be served on the agent of the owner of the property or the party in possession of the property or, if there is no agent or party in possession, the notice may be served by posting the same upon the premises. If the condition is not remedied within 48 hours, the borough may do the work or cause the work to be done with the actual cost to be collected from the property owner by municipal claim or civil action. The certificate of the Borough Council shall be conclusive evidence of the existence of the emergency justifying the repair.
