§ 92.041 EMERGENCIES.
   Nothing in this subchapter shall prevent any person from taking any action which would otherwise be prohibited by this subchapter if such actions are immediately necessary to prevent imminent death, serious bodily harm, or property damage. This section shall be an affirmative defense to any violation of this subchapter and any person relying thereon shall have the burden to establish, by preponderance of the evidence, that the actions were immediately necessary to prevent imminent death, serious bodily harm, or serious property damage and that reasonable efforts were made under the circumstances to contact the Commission or the Borough Manager prior to taking the action.
