§ 92.036 DEFINITIONS.
   For the purpose of this subchapter, the following terms, phrases, words, and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular, and words in the singular include the plural. The word “shall” is mandatory and not merely directory.
   LARGE TREES. Those expected to attain a height in excess of 45 feet at maturity.
   MEDIUM TREES. Those expected to attain a height of 30 feet to 45 feet at maturity.
   MUNICIPALITY. The Borough of Bedford, County of Bedford, Commonwealth of Pennsylvania.
   PARK. Public parks.
   PERSON. Any person, firm, partnership, association, corporation, company, or organization of any kind.
   PROPERTY LINE. The outer edge of a street or highway right-of-way.
   PUBLIC AREAS. All streets and parks as well as all other property owned by the Borough of Bedford which are located in the Borough of Bedford, County of Bedford.
   PUBLIC TREES. All shade and ornamental trees now or hereafter growing on any public areas or where otherwise indicated.
   SHADE TREE COMMISSION (COMMISSION). The body under whose jurisdiction all public trees fall.
   SMALL TREES. Those expected to attain a height of 20 feet to 30 feet at maturity.
   STREET or HIGHWAY. The entire width of every public way or right-of-way when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular and pedestrian traffic.
   STREET TREES. All shade and ornamental trees now or hereafter growing on any public street.
   TREELAWN. The part of a street or highway, not covered by sidewalk or other paving, lying between the property line and that portion of the street or highway usually used for vehicular traffic.
   TREE TOPPING. The severe cutting back of limbs to stubs larger than three inches in diameter within the tree’s crown to such a degree so as to remove the normal canopy and disfigure the tree.
