§ 50.99 PENALTY.
   Any violation or failure to comply with any of the provisions of this chapter or the rules and regulations promulgated pursuant to this chapter, is hereby declared to be a public nuisance which may be abated by either the borough or the Authority. All costs incurred by either the borough or the Authority in abating a nuisance may be recovered from the responsible party. Any person, firm, or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not less than $25 or more than $1,000, plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this chapter continues shall constitute a separate offense. The borough and the Authority, jointly and separately, are authorized to enforce this chapter and to obtain injunctive relief mandating compliance with the requirements of this chapter and the regulations promulgated pursuant thereto.
